1. Contractual Relationship

These Terms of Service (“Terms”) govern your access or use of the applications, websites, content, products, and services made available by FarmGo. By accessing or using our platform, you confirm your agreement to be bound by these Terms. If you do not agree to these Terms, you may not access or use the services.

2. The FarmGo Marketplace

FarmGo operates a decentralized digital marketplace connecting local agricultural producers (“Farmers” / “Sellers”) directly with consumers and institutional buyers (“Buyers”). FarmGo facilitates transaction negotiation, digital payments, and delivery scheduling. However, the contract of sale is strictly between the Buyer and Seller. We do not take ownership of the agricultural products listed on the platform.

3. User Accounts

To access most aspects of the services, you must register for and maintain an active user account (“Account”). You must be at least 18 years of age to register. Account registration requires you to submit personal information such as name, address, and mobile phone number. You agree to maintain accurate, complete, and up-to-date information in your Account. You are responsible for all activity that occurs under your Account, and you agree to maintain the security of your username and password.

4. Listings and Quality Standards

• Farmer Obligation: Sellers must describe the grade, weight, harvest date, and organic status of produce accurately. Listings containing misleading photos or inaccurate pricing will be flagged and removed.
• Pricing & Payments: Prices are set by the Farmers. All prices listed on the app are binding at checkout. Buyers agree to pay all charges, including transport or delivery fees.
• Harvest Estimates: Harvest schedules are weather-dependent and are approximations. Slight deviations in shipping dates are normal and will be communicated transparently.

5. Acceptable Use Policy

You may not use the services to transmit spam, execute mock orders, attempt payment manipulation, or systematically scrape pricing data without our explicit written permission. Violation of these terms will lead to immediate account suspension and potential legal action.

6. Limitation of Liability

FarmGo shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the agricultural produce purchased through the marketplace. The quality, freshness, and safety of the produce are the sole responsibility of the selling farmer.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising in connection with these Terms or the use of FarmGo shall be resolved in the courts of Pune, Maharashtra.

8. Modifications

We reserve the right to amend these Terms from time to time. Your continued use of the website or mobile application after terms update notices are posted constitutes your binding consent to the modified terms.
